Family and Medical Leave Act (FMLA) Amended – Effective January 16, 2009, the Family and Medical Leave Act of 1993 (FMLA) was amended to include two additional leave entitlements; ‘qualifying exigency leave’ and ‘military caregiver leave’, referred to together as ‘military family leave provisions’.
Under the ‘qualifying exigency’ provision, an employee whose spouse, son, daughter, or parent is a service member in the Armed Forces and is on active duty or notified of an impending call to duty, may be granted up to 12 weeks of FMLA leave. The ‘military caregiver leave’ benefit provides up to 26 weeks of FMLA caregiver leave during a single 12-month period to an employee who is the spouse, son, daughter, parent, or nearest blood relative of a member of the Armed Forces who has suffered an injury or illness while on active duty.
